The ruling was issued on 23 December 2025 by Hon. Justice Bello Kawu while presiding over Motion No: M/17220/2025.

According to the court order, the bail was granted under the same conditions previously considered by the EFCC, which include the surrender of Malami’s international passport and the execution of bail bonds by two sureties.

The sureties consist of the Director-General of the Nigerian Legal Aid Council and a serving member of the House of Representatives representing the Augie/Argungu Federal Constituency.

The court also reviewed and reactivated earlier fulfilled bail conditions dated 28 November 2025, which required the provision of the two sureties and the surrender of the applicant’s international passport.

Justice Bello Kawu stated that the application for bail was granted on the grounds of exceptional hardship, pending the hearing and determination of the substantive motion on notice.

The case has been adjourned to 5 January 2026 for the hearing of the motion on notice.

The order was issued under the seal of the High Court of Justice, Abuja, and signed by the Registrar, Hadiza Sambo Gwandu.

An impeccable source who confirmed the interim bail reported that Malami has accepted the conditions set by the EFCC and that the case has been adjourned to 5 January 2026.
