Demolition: Zaria Residents Seek Arrest Of NCAT, KASUPDA Officials

Residents of Agwan Yusi in Zaria, Kaduna State are praying that a Magistrate Court should order for the arrest of officials of Nigeria College of Aviation Technology (NCAT) and Kaduna State Urban Planning Development Authority (KASUPDA), if they failed to appear in court.

Meanwhile, the Magistrate Court sitting in Kings Road, Sabon Gari Zaria Local Government Area of Kaduna State presided by Justice Yakubu Badamasi has adjourned till January, 31 2022, on a case of illegal trespass and demolition of property filed by the Residents of Agwan Yusi in Zaria.

The case between Nigeria College of Aviation Technology, Zaria and Residents of Agwan Yusi Zaria was mentioned in court this Wednesday.

However, the case was adjourned due to the absence of the two defendants in the case – Nigerian College of Aviation Technology, Zaria and Kaduna State Urban Planning Development Authority, KASUPDA.

The absence has angered the residents who are now praying that the court should order for the officials if they did not appear in the next sitting.

Speaking to newsmen at the court premises, Counsel to the defendants, Barrister A. A Akume said his clients were not in court because notice was not served.

Akume, however, pleaded to ensure his clients appearance in the next sitting.

But Counsel to the plaintiff, Solomon Kaine, had submitted that the court should order for the arrest of the two defendants if they failed to appear in the next sitting.

Recall that Kaduna State Governor, Mallam Nasir Ahmed El-Rufai, had on a National TV claimed that the residents illegally encroached into the NCAT land without permission.

But the occupants of the demolished properties said they acquired the landed properties through legitimate process adding that they have valid documents to prove the deal was legitimate.

Elanza news reports that most of the residents appeared in court with their Certificates of Occupancy (C of O).

KASUPDA, an agency of Kaduna State Government had demolished over 160 houses in the area, despite pending court cases where some were ruled in favour of the community.

This prompted residents with the valid documents to approach the court.
